Terms of Service

Welcome to StormScape! These Terms of Service ("Terms") are a legal agreement between you and StormScape ("we," "our," or "us"). By accessing or using our web application, Discord bot, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use StormScape.

Eligibility

• You must be at least 13 years old to use StormScape
• If you are between 13 and 18, you must have parental or guardian consent
• By using the Service, you represent that you meet these requirements

Agreement to Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

StormScape is an AI-powered platform for tabletop roleplaying game (TTRPG) players and Dungeon Masters, offering:

• Campaign Management: Wiki-style content for NPCs, locations, factions, items, and notes
• Session Recording: Audio recording of Discord voice channel sessions
• AI Transcription: Automatic transcription of recorded sessions with speaker identification
• Intelligence Reports: AI-generated campaign analysis and summaries
• Character Tracking: Player and NPC management with relationship mapping
• Discord Integration: Bot for audio playback and session recording

Beta Status

StormScape is currently in beta. This means:

• Features may change, be added, or be removed without notice
• You may encounter bugs or service interruptions
• We appreciate your patience and feedback as we improve the platform

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will make reasonable efforts to notify users of significant changes.

Account Creation

• You must authenticate using a valid Discord account
• You must provide accurate information
• One account per person—no shared or duplicate accounts

Account Security

• You are responsible for maintaining the security of your Discord account
• You are responsible for all activities that occur under your account
• Notify us immediately if you suspect unauthorized access

Account Termination

You may delete your account at any time through your account settings. We may suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or harass other users
• Remain inactive for an extended period (with notice)

Pricing Tiers

StormScape offers multiple subscription tiers with different features and limits. Current pricing is available at stormscape.app.

Free Tier

• Limited campaigns and storage
• Basic features
• May be subject to usage limits

Paid Subscriptions

• Billing: Subscriptions are billed monthly or annually in advance
• Automatic renewal: Subscriptions automatically renew unless cancelled
• Payment processing: Handled securely by Stripe
• Currency: All prices are in USD unless otherwise specified

Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• No partial refunds for unused time in a billing period

Refunds

• Refunds are provided at our discretion

• We may offer refunds for technical issues that prevent use of the Service

Price Changes

We may change subscription prices with at least 30 days notice. Price changes take effect at your next renewal date.

Ownership

You retain ownership of all content you create, upload, or submit to StormScape ("User Content"), including:

• Campaign content (wiki entries, notes, etc.)
• Character information
• Audio recordings of your sessions
• Any other content you provide

License to StormScape

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, host, and back up your content
• Process your content with AI to provide intelligence features
• Display your content to you and users you share it with
• Perform technical operations necessary to provide the Service

This license exists only for the purpose of providing the Service. We do not claim ownership of your content.

Content Restrictions

You agree not to upload, post, or transmit content that:

• Is illegal or promotes illegal activities
• Infringes intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is defamatory, harassing, or threatening
• Contains child sexual abuse material (CSAM)
• Violates any person's privacy rights

DMCA & Copyright

We respect intellectual property rights. If you believe content on StormScape infringes your copyright, contact us at [email protected] with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief that the use is unauthorized
• Your signature (electronic or physical)

This is an important section—please read carefully.

Nature of AI Content

StormScape uses artificial intelligence to generate:

• Session transcriptions
• Interval summaries
• Intelligence reports
• Character journey narratives
• Relationship suggestions

AI Limitations

You understand and agree that:

• AI-generated content may contain errors, inaccuracies, or misinterpretations
• Transcriptions may not be 100% accurate, especially with multiple speakers, accents, or background noise
• AI summaries and reports are interpretive—they may miss or mischaracterize story elements
• AI relationship suggestions are automated guesses, not definitive analyses

Your Responsibility

• You should review all AI-generated content for accuracy
• You are responsible for how you use AI-generated content
• Do not rely on AI content for anything beyond your TTRPG campaigns

No Liability for AI Content

We are not liable for:

• Inaccuracies in transcriptions or summaries
• Story elements the AI misses or misinterprets
• Offensive or inappropriate AI outputs (though we work to prevent these)
• Any decisions you make based on AI-generated content

This is a critical section. Recording without consent may violate laws in your jurisdiction.

Your Responsibilities

Before using StormScape's recording feature, you must:

• Inform all participants that the session will be recorded
• Obtain consent from every person in the voice channel
• Respect anyone's decision to not be recorded
• Understand and comply with local laws regarding audio recording

Legal Considerations

Audio recording laws vary by jurisdiction:

• Some places require "one-party consent" (only the person recording needs to consent)
• Other places require "all-party consent" (everyone being recorded must consent)
• Recording laws may differ for private vs. public conversations
• It is YOUR responsibility to know and comply with applicable laws

Our Role

• We provide the recording technology as a tool
• We are not responsible for your use of this tool
• We do not verify that you have obtained proper consent
• You agree to indemnify us for any claims arising from improper recording

Recommended Practice

We strongly recommend:

• Announcing recordings at the start of each session
• Getting written confirmation of consent (e.g., in a group chat)
• Offering to pause recording if someone needs to say something privately
• Respecting opt-out requests immediately

Permitted Uses

StormScape is designed for managing tabletop roleplaying game campaigns. Permitted uses include:

• Creating and managing campaign content
• Recording game sessions with proper consent
• Using AI features to organize and summarize your campaign
• Sharing content with your gaming group

Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose
• Record conversations without proper consent
• Share access to your account with others
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated scripts, bots, or scrapers (except our official API, if available)
• Overwhelm our systems with excessive requests
• Circumvent usage limits or restrictions
• Impersonate other users or StormScape staff
• Use the Service to harass, stalk, or threaten anyone
• Upload content that violates others' rights
• Interfere with other users' enjoyment of the Service

Fair Use of Resources

• Recording time, storage, and AI processing are subject to reasonable limits
• Excessive usage may result in throttling or account review
• We reserve the right to set and enforce usage limits

Discord Terms

When using StormScape's Discord integration, you are also bound by:

• Discord's Terms of Service
• Discord's Community Guidelines
• Discord's Privacy Policy

Bot Permissions

Our Discord bot requires certain permissions to function:

• Voice channel access for recording and audio playback
• Message reading for commands
• User information for identification

Only grant permissions you're comfortable with. You can revoke bot access at any time through Discord's settings.

No Discord Affiliation

StormScape is not affiliated with, endorsed by, or sponsored by Discord Inc. Discord is a trademark of Discord Inc.

StormScape IP

StormScape and its original content, features, and functionality are owned by us and are protected by:

• Copyright
• Trademark
• Trade secret laws
• Other intellectual property rights

Our trademarks, logos, and service marks may not be used without our prior written consent.

Your Content

You retain all rights to content you create. However, by using the Service, you grant us the limited license described in Section 5.

Game System Content

StormScape is a tool for managing campaigns—we do not own any game system content:

• Dungeons & Dragons is a trademark of Wizards of the Coast
• Other game systems are owned by their respective publishers
• You are responsible for your use of game-related content
• We do not encourage or endorse copyright infringement

Feedback

If you provide us with feedback, suggestions, or ideas, you agree that we may use them without compensation or attribution to you.

• NON-INFRINGEMENT

No Guarantee of Availability

We do not guarantee that:

• The Service will be available at all times
• The Service will be error-free
• Defects will be corrected
• The Service will meet your specific requirements

Beta Features

Features marked as "beta" or "experimental" are:

• Provided for testing purposes
• Subject to change or removal
• Not covered by our standard service commitments

Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMSCAPE SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services

Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF:

• The amount you paid us in the twelve (12) months preceding the claim, OR
• One hundred US dollars ($100)

Basis of the Bargain

These limitations are fundamental elements of the agreement between you and StormScape. The Service would not be provided without these limitations.

You agree to indemnify, defend, and hold harmless StormScape and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your recording of sessions without proper consent

We reserve the right to assume exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with us.

Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in settings
• Contacting us at [email protected]

Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period (with prior notice)
• We discontinue the Service

Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your content (see our Privacy Policy for data retention details)
• No refunds for unused subscription time
• Provisions that should survive (like liability limitations) will remain in effect

Informal Resolution

Before filing any legal claim, you agree to try to resolve disputes informally by contacting us at [email protected]. We'll try to resolve the dispute within 60 days.

Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.

Venue

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in Delaware, and you consent to personal jurisdiction in these courts.

Limitation on Time to File Claims

Any cause of action you may have arising from these Terms must be filed within one (1) year after the cause of action accrues, or it is permanently barred.

We reserve the right to modify these Terms at any time.

Notification of Changes

• Minor changes: Updated "Last Updated" date
• Material changes: Email notification and/or prominent in-app notice at least 30 days before changes take effect

Acceptance of Changes

Your continued use of StormScape after changes become effective constitutes acceptance of the new Terms. If you do not agree to the revised Terms, please stop using the Service.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and StormScape regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.

Headings

Section headings are for convenience only and have no legal effect.
